1. INTRODUCTION
These Terms of Use ("Agreement") regulate the use of the Caspy mobile application, Caspy.co website, AI Labs services, premium membership services, virtual credit system, future direct messaging services, and all related products, services, software, content, and technologies.
Caspy is a digital social media and content production platform designed for musicians, producers, content creators, artists, and the music community.
The Platform may include the following features:
• Short video ("Capsule") sharing
• Temporary content ("Spark") sharing
• Music-focused content broadcasting
• Profile creation
• Follow system
• Comment system
• Like system
• Repost system
• Rating system
• Notification system
• Premium membership services
• Virtual credit system
• AI Labs tools (AI Lyrics, AI Clip, AI Music)
• Future direct messaging services
• Other features that Caspy may develop in the future
Caspy services are operated by:

This Agreement is a legally binding contract between the user and Caspy.

3. ACCEPTANCE OF TERMS
The user is deemed to have accepted this Agreement when performing any of the following actions:
• Creating an account
• Downloading the application
• Accessing the website
• Uploading content
• Viewing content
• Using AI Labs
• Purchasing a premium membership
• Purchasing virtual credits
• Using any of the Caspy services
If the user does not agree to these terms, they must not use the services.
Caspy reserves the right to modify this Agreement at any time.
Significant changes may be notified to users via;
• in-app notification,
• e-mail,
• website announcement,
• or other reasonable methods.
Continued use of the services after changes indicates acceptance of the updated terms.
4. DEFINITIONS
The following definitions apply in this Agreement:
Caspy
Refers to the Caspy mobile application, Caspy.co website, and all related services.
User
Refers to the real person who accesses the platform, registers, or uses the services in any way.
Content
Refers to text, comments, music, audio recordings, videos, visuals, profile photos, usernames, biographies, links, AI outputs, and all other materials.
Capsule
Refers to short video contents published on Caspy.
Spark
Refers to temporary video or image contents that the user publishes for a self-selected period of 1, 2 or 3 days and that are automatically removed when that period expires.
AI Labs
Refers to the artificial intelligence-supported content production tools offered within Caspy, including AI Lyrics, AI Clip and AI Music.
AI Music
Refers to the AI Labs feature that generates audio tracks from a brief, style/mood selections and optional song lyrics provided by the user.
Premium Membership
Refers to paid subscription services that provide additional features.
Credit
Refers to virtual digital points that can be consumed for the use of AI Labs and certain other features.
DM
Refers to the private messaging system that may be made available in the future.
5. ELIGIBILITY AND 18+ AGE REQUIREMENT
Caspy is designed solely for individuals 18 years of age and older.
By creating an account, the user declares and warrants the following:
• They are at least 18 years old,
• They are of legal age,
• They possess the legal capacity to enter into a binding contract,
• The information they provide is accurate,
• The use of Caspy is legal in the country where they are located.
It is strictly prohibited for individuals under the age of 18 to use Caspy.
Caspy is not a service aimed at children.
Caspy does not knowingly collect personal data belonging to children.
6. AGE VERIFICATION
Caspy may request age verification in the following situations:
• Doubt regarding the user's age,
• Receiving a report about the user,
• Conducting a security review,
• Detecting risk in the use of AI Labs,
• Fulfilling legal obligations.
Caspy may perform the following actions:
• Temporarily suspend the account,
• Request documentation,
• Ask for additional verification,
• Permanently close the account.
False age declaration is considered a material breach of the contract.
7. ACCOUNT CREATION
The user can create an account using the following methods:
Email and Password
The user can create an account by providing a valid email address.
Login with Google
The user can create an account using Google OAuth services.
Login with Apple
The user can create an account using the Sign In with Apple system.
Caspy may add different authentication methods in the future.
8. ACCOUNT SECURITY
The user is responsible for:
• Protecting their password,
• Limiting access to their account,
• Keeping their login information confidential,
• Actions performed through their account.
The user cannot:
• Sell their account,
• Rent their account,
• Transfer their account,
• Use someone else's account,
• Take over an account belonging to someone else,
• Trade accounts.
Caspy does not guarantee the elimination of all risks arising from account security.
9. USERNAMES AND PROFILE INFORMATION
A user profile may include the following:
• Username
• Artist name
• Profile photo
• Biography
• Music links
• Spotify links
• Apple Music links
• YouTube Music links
• Social media links
Caspy may reject or remove the following profile information:
• Impersonating accounts
• Names constituting trademark infringement
• Names constituting rights infringement
• Names containing hate speech
• Deceptive usernames
Caspy does not grant property rights over usernames.
10. PROHIBITED ACCOUNT USES
The following activities are strictly prohibited:
Fake Accounts
Misleading accounts created to conceal identity.
Bot Accounts
Accounts managed by automated software.
Manipulation Accounts
Accounts used for engagement manipulation.
Spam Accounts
Accounts spreading unsolicited content.
Fraud Accounts
Accounts with fraudulent intent.
Account Farms
Systems manipulating the platform through bulk account usage.
Premium Abuse
Accounts aimed at abusing the Premium system or the credit system.
Caspy may, without prior notice, do the following to such accounts:
• suspend,
• limit,
• permanently close.
11. AVAILABILITY OF SERVICES
Caspy services are provided "as is" and "as available".
Caspy does not guarantee:
• uninterrupted access,
• error-free operation,
• zero occurrences of data loss,
• continuous availability of all features.
Platform features may be, at any time:
• changed,
• removed,
• limited,
• made paid.

PART 2 – USER CONTENT, COPYRIGHTS, MUSIC RIGHTS AND LICENSING
12. USER CONTENT AND APPLE/STORES EULA PROVISIONS
Caspy is a User Generated Content ("UGC") platform that allows users to create, upload, publish, and share content.
Users may upload the following content:
• Short videos (Capsule)
• Temporary videos and images (Spark)
• Music recordings
• Audio files
• Visuals
• Cover visuals
• Profile photos
• Biography texts
• Comments
• Text posts
• Links
• AI-supported content
• Other content types supported by Caspy
APPLE AND GOOGLE PLAY EULA ZERO TOLERANCE AND 24-HOUR MODERATION COMMITMENT:
• Zero Tolerance Policy: Caspy strictly prohibits and enforces zero tolerance for objectionable, abusive, harassing, hateful, obscene, violent, infringing, or illegal content and user behavior.
• In-App Reporting and Blocking: Users are provided with in-app reporting tools on every Capsule video, Spark, post, comment, and profile page to report objectionable content, as well as immediate blocking ("Block") features to stop interactions from unwanted users.
• 24-Hour Action SLA: Reported or flagged objectionable content and abusive user accounts are reviewed by Caspy moderation teams within 24 hours. Offending content will be promptly removed, and violating user accounts will be suspended or permanently banned.
The user is exclusively responsible for all content they upload.
13. DECLARATION OF RIGHTS OVER CONTENT
When the user uploads content to Caspy, they explicitly declare and warrant the following:
The content they upload:
• belongs to them, or,
• all necessary permissions have been obtained,
• can be used legally,
• does not violate the rights of third parties,
• is not contrary to contract and license obligations.
The user accepts that they hold the following rights or have obtained necessary permissions:
• Copyrights
• Composition rights
• Master recording rights
• Publishing rights
• Performing artist rights
• Producer rights
• Trademark rights
• Personality rights
• Privacy rights
• Visual usage rights
14. MUSIC RIGHTS
Caspy is a music-focused platform.
Therefore, the user is directly responsible for the following matters:
Master Recording Rights
Rights regarding the use of the audio recording.
Composition Rights
Rights regarding the lyrics and composition.
Publishing Rights
Commercial usage rights of the musical work.
Mechanical Rights
Reproduction and digital distribution rights.
Performance Rights
Public use and performance rights.
Sampling Rights
Permissions for the samples used.
Remix Rights
Permissions for remixes or rearrangements.
Featured Artist Rights
Permissions of the featured artists.
Producer Rights
Rights of the producer.
Session Musician Rights
Rights of studio musicians.
Caspy is not obligated to verify the existence of these rights.
15. VISUAL AND VIDEO CONTENT
The user declares that they have the necessary rights over the following:
• Video recordings
• Clips
• Visuals
• Cover designs
• Photos
• Animations
• AI productions
The user cannot upload the following:
• Stolen visuals
• Unlicensed stock visuals
• Unauthorized photos
• Unauthorized videos
• Pirated content
Caspy may remove content suspected of infringement.
16. PROFILE PHOTOS AND PORTRAITS
The user may use the following materials:
• Their own photo
• Their own portrait
• Their own face
• Their own voice
• Artist visuals belonging to them
However, the following are prohibited:
• Using another person's face without permission
• Using another person's voice without permission
• Using another person's portrait without permission
• Impersonating an identity
• Creating a fake artist profile
Caspy may remove these contents.
17. CONTENT CONCERNING MINORS
Caspy enforces a zero-tolerance policy regarding child safety.
The following are strictly prohibited:
• Inappropriate visuals of minors
• Sexually explicit depictions of minors
• Child abuse content
• Content targeting children
• Deepfake productions targeting children
• Use of child faces in AI productions
Such contents:
• may be removed immediately,
• the account may be closed,
• may be reported to authorized institutions.
18. EXPLICIT CONTENT REGIME
Caspy is a platform for adults.
Therefore, the following contents alone do not constitute a violation:
• Profane rap lyrics
• Music containing harsh language
• Adult-themed content
• Outspoken artistic expressions
• Explicit songs
However, the following contents are prohibited:
Hate Speech
Targeting based on race, ethnicity, religion, gender, or similar reasons.
Harassment
Persistent bothersome behaviors.
Threats
Threats of physical harm.
Call for Violence
Contents encouraging violence.
Doxxing
Disclosure of personal information.
Terrorist Propaganda
Contents supporting terrorist organizations.
Illegal Activities
Contents encouraging crime.
Child Abuse
All kinds of child abuse material.
Caspy may apply the following to explicit content:
• age tag,
• content warning,
• access restriction,
• visibility limitation.
19. LICENSE GRANTED BY THE USER
The user grants the following license to Caspy for the content they upload:

Worldwide.
Fee
Royalty-free.
Duration
As long as the content is associated with the platform.
Sublicense
Can be granted.
This license is necessary for Caspy to provide its services.
20. RIGHTS CASPY MAY EXERCISE
Caspy may perform the following operations:
• Store the content
• Publish the content
• Stream the content
• Create a thumbnail
• Create a preview
• Transcode
• Compress
• Resize
• Use in algorithms
• Show in recommendation systems
• Analyze in security systems
• Review for moderation purposes
These rights are used solely for the purpose of operating the services.
21. AUTHORITY TO REMOVE CONTENT
Caspy may remove contents in the following situations:
• Suspicion of copyright infringement
• Suspicion of rights infringement
• Violation of community guidelines
• Legal obligations
• Security risks
• Spam activities
• Deepfake violations
• Fake account activities
Caspy cannot be held liable to the user due to content removal decisions.
22. REPEATED VIOLATIONS
If the same user continuously engages in:
• Copyright infringement,
• Deepfake violation,
• Spam activities,
• Rights violations,
Caspy may permanently close the account.
23. COPYRIGHT NOTICES
Right holders may submit notices via the following address:

Upon receiving a valid notice, Caspy may:
• Remove the content,
• Restrict access,
• Suspend the account,
• Initiate a counter-notice process.
24. RIGHT TO COUNTER-NOTICE
Users whose content has been removed may:
• object to the removal decision,
• prove their right ownership,
• send a counter-notice.

25. DELETION OF CONTENT AND AUTOMATIC EXPIRY OF SPARKS
The user may delete their content.
Sparks are temporary content. When the user publishes a Spark, they select a display period of 1, 2 or 3 days; at the end of that period the Spark is automatically removed from the platform without requiring any action from the user. The user may also delete a Spark manually at any time before it expires.
The user accepts that:
• Caspy does not guarantee that an expired Spark can be restored,
• other users may capture or record a Spark while it is visible, and Caspy cannot prevent this,
• the view and reaction records of a Spark are visible only to its owner.
Expiry of a Spark does not remove Caspy's obligation to retain moderation, security and legal records set out below.
However, the following records may be kept for certain periods:
• Backup records
• Moderation records
• Security records
• Legal records
• Payment records
• Dispute records
These retention processes are carried out in accordance with relevant legislation.

PART 3 – AI LABS, GENERATIVE ARTIFICIAL INTELLIGENCE SERVICES, FACE/VOICE USAGE AND AI CONTENTS
26. AI LABS SERVICES
Caspy may offer various artificial intelligence-supported services under the name "AI Labs" to support users' creative content production.
Services that may be offered under AI Labs can include the following:
• AI Lyrics
• AI Clip
• AI Music (AI-generated audio tracks)
• AI Visual Generation
• AI Video Generation
• HD Export (1080p / 2K / 4K upscaling of AI Clips)
• AI Cover Art
• AI Text Generation
• AI Audio Analysis
• AI Content Editing
• AI Editing and Montage Tools
• Other artificial intelligence features to be developed by Caspy in the future
Caspy reserves the right to modify, improve, limit, or completely remove AI Labs services at any time.
27. AI LYRICS
The AI Lyrics feature can generate song lyric drafts in accordance with the commands ("Prompt"), descriptions ("Brief"), keywords, or reference information provided by the user.
The user accepts that:
• Contents generated by AI may contain errors.
• AI outputs may not be unique.
• Similar inputs may produce similar results.
• Caspy does not guarantee that any AI output is original.
• Caspy does not guarantee that any AI output complies with copyright.
The use of lyrics generated by AI is entirely under the user's responsibility.
28. AI CLIP AND AI MUSIC
28.1 AI CLIP
The AI Clip feature may allow the user to generate video or visual content through:
• Audio files,
• Reference visuals,
• Prompts,
• Descriptions,
• Cover visuals,
• Their own photos.
A completed AI Clip may optionally be exported at a higher resolution (1080p, 2K or 4K) through the HD Export feature, which consumes additional credits.
28.2 AI MUSIC
The AI Music feature may allow the user to generate an audio track through:
• A brief describing the desired song,
• Genre, mood and vocal-style (female, male, duet or instrumental) selections,
• Song lyrics selected from the user's own AI Lyrics projects or entered manually by the user,
• Optionally, no lyrics at all (instrumental production).
Generated tracks may be produced at a length of 60, 120 or 180 seconds; the length affects the credit cost.
The user declares and warrants that any lyrics they enter manually belong to them or that they have obtained the necessary permissions. Entering the lyrics of a third party's copyrighted work is prohibited.
AI Music outputs are machine-generated productions. They:
• may resemble existing works,
• may not be original,
• may produce similar results for similar inputs,
• may not be eligible for copyright protection under the legislation of certain countries.
Caspy makes no representation as to whether an AI Music output may be registered with a collecting society, distributed to digital music platforms, or monetized. Verifying this is entirely the user's responsibility.
28.3 COMMON PROVISIONS
For both features, Caspy does not guarantee that the production result will:
• Provide the expected quality,
• Be suitable for commercial use,
• Not contain technical errors.
29. CONTENTS UPLOADED TO AI
For any material uploaded to AI systems, the user declares the following:
• They are the right holder,
• They have obtained the necessary permissions,
• They do not violate the rights of third parties,
• They allow Caspy and relevant AI providers to process them.
These materials may include:
• Audio recordings
• Songs
• Visuals
• Photos
• Reference videos
• Prompts
• Text descriptions
• Portraits
The user assumes all legal responsibility arising from the use of these materials.
30. USER'S USE OF THEIR OWN PHOTO
Caspy may allow users to use their own:
• Photos,
• Portraits,
• Faces,
• Voices,
• Visual likenesses
in AI productions.
When the user uploads their own photo, they declare the following:
• The person in the photo is themselves,
• They are at least 18 years old,
• They give explicit consent for processing activities,
• They do not impersonate any third party.
31. PHOTOS AND VOICES OF THIRD PARTIES
The user cannot upload the following to AI systems:
• Unauthorized third-party photos
• Unauthorized third-party portraits
• Unauthorized third-party faces
• Unauthorized third-party voices
• Unauthorized identity likenesses
The user is obliged to prove that the necessary permissions exist.
Caspy may, when deemed necessary:
• Request proof,
• Stop the production,
• Remove the content,
• Suspend the account.
32. FACES AND VOICES OF MINORS
To protect children, the following are strictly prohibited:
• Uploading photos of minors,
• Uploading voices of minors,
• Generating AI productions using child faces,
• Creating a child identity,
• Generating synthetic characters resembling children,
• Creating deepfake contents featuring children.
These violations are considered severe violations.
In such cases, Caspy may:
• Remove the content,
• Permanently close the account,
• Cooperate with authorized authorities.
33. DEEPFAKE PROHIBITION
Caspy does not allow the use of deceptive deepfakes.
The following are prohibited:
• Creating fake news
• Misrepresenting people
• Misleading the public
• Impersonating other people
• Using synthetic media for fraudulent purposes
When Caspy evaluates any content as deepfake, it may:
• reduce its visibility,
• label it,
• remove it,
• suspend the account.
34. CELEBRITIES AND PUBLIC FIGURES
The user cannot do the following:
• Use celebrity faces without permission
• Copy celebrity voices
• Impersonate public figures
• Generate deceptive content
• Open an account on behalf of a celebrity
• Create fake interviews with AI
Contents that are a parody or clearly fictional may be evaluated separately by Caspy.
35. VOICE CLONING
If voice cloning features are offered, the user declares that:
• The voice belongs to them,
• They have obtained necessary permissions,
• They do not violate third-party rights.
Unauthorized voice cloning is strictly prohibited.
36. FACE CLONING
If face cloning or portrait generation features are offered, the user declares that:
• They have necessary rights over the utilized face,
• Permissions have been obtained,
• The content is not deceptive.
Caspy may reject any production.
37. OWNERSHIP OF AI OUTPUTS
To the extent permitted by legislation, the user may hold rights over the outputs they generated via AI systems.
However, Caspy does not guarantee that the outputs:
• Comply with copyright,
• Have the quality of a protectable work,
• Are unique,
• Do not violate third-party rights.
The user is obliged to make the necessary legal assessments before using the outputs.
38. COMMERCIAL USE OF AI OUTPUTS
Unless stated otherwise by Caspy, the user may commercially use the AI outputs they created.
However, the user is responsible for:
• Copyright risks
• Trademark risks
• Personality rights risks
• Advertising law obligations
• Compliance with local legislation
Caspy is not responsible for disputes arising from commercial use.
39. AI MODERATION
Caspy may use the following methods:
Automated Moderation
Machine learning systems.
Human Moderation
Authorized review teams.
Hybrid Moderation
The combined use of automated and manual review.
Caspy may do the following to any AI production:
• reject,
• stop,
• remove,
• limit its visibility.
40. AI PROVIDERS
Caspy may utilize the following providers:
• Google Gemini (lyrics, storyboard, music direction, audio analysis)
• fal.ai (provider gateway)
• MiniMax H3 – video generation, via fal.ai
• MiniMax Music 3 – music generation, via fal.ai
• Nano Banana Pro – image generation, via fal.ai
• ByteDance Upscaler – HD export, via fal.ai
• Amazon Web Services (rendering and composition infrastructure)
• Similar third-party providers
These providers may change over time.
By using AI services, the user agrees to the necessary data processing activities.
41. AI CREDIT CONSUMPTION
AI Labs services may consume credits.
Each operation may use a different amount of credits.
Caspy may:
• change credit costs,
• create new credit categories,
• make certain operations paid.
42. FAILED AI PRODUCTIONS
For productions that fail due to technical reasons, Caspy may:
• offer a retry,
• issue a credit refund,
• provide a partial credit refund.
However, Caspy does not guarantee an automatic refund for every failed operation.
43. SUSPENSION OF AI SERVICES
Caspy may at any time:
• remove AI Labs services,
• turn off certain models,
• switch to new providers,
• limit access.
The user cannot expect AI features to be continuously provided.

44. PREMIUM MEMBERSHIPS
Caspy may offer certain features under a paid subscription model.
Premium memberships may provide users with advantages not found in standard accounts.
Premium advantages may be modified, expanded, or removed over time.
Caspy may offer certain premium features only in specific regions.
45. PREMIUM FEATURES
Advantages that may be offered under premium membership can include the following:

Premium membership features may include:
Verified Badge
Displaying a verified account badge on the user profile.
Capsule Spotlight Rights
• Active Premium subscribers receive 2 Capsule Spotlight rights per UTC calendar month.
• Unused Spotlight rights do not roll over to subsequent months.
• Applying a Spotlight right to an owned capsule grants a fixed 7-calendar-day feed and explore ranking priority boost (Spotlight boost).
• Once initiated, a Spotlight application is non-cancelable, non-transferable, non-refundable, and irreversible, even if the capsule is subsequently deleted by the user or removed due to moderation.
• Spotlight provides owner-facing status tracking; it does not display promotional badges to third-party viewers and does not guarantee fixed view counts or commercial results.
AI Labs Credits
Periodic AI credits defined according to the subscription tier.
Advanced Analytics and Priority Access
Content performance insights and early access to new features.
46. PREMIUM PLANS
Caspy may offer the following plans:
Monthly Premium
A monthly-renewed subscription.
Annual Premium
An annually-renewed subscription.
Campaign Plans
Promotional plans offered during specific periods.
Free Trial
Trial periods that may be offered to certain users.
Plans may vary by country and platform.
47. AUTOMATIC RENEWAL
Premium memberships may automatically renew unless stated otherwise.
By purchasing a subscription, the user agrees to:
• automatic renewal,
• the rules of the relevant store,
• fee collection.
The renewal may continue unless the subscription is canceled.
48. APPLE APP STORE SUBSCRIPTIONS
Subscription transactions performed on iOS devices are carried out through:
• Apple App Store
• Apple In-App Purchase
systems.
Caspy does not have direct control over collection processes performed by Apple.
Issues originating from Apple:
• payment errors,
• card issues,
• collection problems,
• refund processes
may be subject to Apple policies.
49. GOOGLE PLAY SUBSCRIPTIONS
Subscription transactions performed on Android devices are carried out through:
• Google Play Billing
• Google Play Store.
Payment processes executed by Google are subject to Google's relevant policies.
50. REVENUECAT INFRASTRUCTURE
Caspy may utilize the RevenueCat infrastructure for subscription and digital rights management processes.
RevenueCat may be used for the following purposes:
• Management of Premium rights
• Verification of subscription status
• Purchase history check
• Restore operations
• Cross-platform synchronization
The user agrees to necessary data sharing with RevenueCat.
51. VIRTUAL CREDITS
Caspy may use a virtual credit system for certain features.
Credits:
• Have the nature of a digital product.
• Are not money.
• Are not electronic money.
• Are not securities.
• Are not investment instruments.
Credits can only be used within Caspy services.
52. CREDIT PACKAGES
Caspy may offer the following one-time credit packages:
• 100 Credits Pack (caspy_credits_100)
• 250 Credits Pack (caspy_credits_250)
• 500 Credits Pack (caspy_credits_500)
• 750 Credits Pack (caspy_credits_750)
• 1000 Credits Pack (caspy_credits_1000)
• 2000 Credits Pack (caspy_credits_2000)
Caspy reserves the right to adjust credit pack sizes, pricing, and promotional tiers in the future.
53. USAGE AREAS OF CREDITS AND CONSUMPTION RATES
Credits may be consumed for AI Labs and platform features at the following standard rates:
• AI Lyrics Generation: 10 Credits
• AI Lyrics Refinement: 5 Credits
• AI Music Direction (style and lyric arrangement): 10 Credits
• AI Music 60-Second Track: 40 Credits
• AI Music 120-Second Track: 70 Credits
• AI Music 180-Second Track: 100 Credits
• AI Clip Storyboard Draft: 25 Credits
• AI Clip Final Reference Image / Frame Revision: 25 Credits (frame revision: 12 Credits)
• AI Clip 15-Second Video Render: 500 Credits
• AI Clip 30-Second Video Render: 900 Credits
• AI Clip 45-Second Video Render: 1300 Credits
• Segment Video Regeneration: 86 Credits

The rates above reflect the situation as of the date of this Agreement. The current cost of each operation is displayed to the user in the app before the operation is confirmed, and the amount displayed at that moment applies.
54. VALIDITY PERIOD OF CREDITS
Credits purchased within the Caspy credit system:
may be valid for 12 months from the date of purchase.
Credits unused at the end of the 12-month period:
• may expire,
• may be deleted,
• may not be restored.
The user accepts this condition.
55. NON-TRANSFERABILITY OF CREDITS
Credits:
• cannot be transferred to other users,
• cannot be sold,
• cannot be rented,
• cannot be transferred,
• cannot be inherited.
Unless Caspy offers a feature to the contrary, credit transfers cannot be made.
56. NON-CONVERTIBILITY OF CREDITS INTO CASH
Credits:
• are not cash money,
• cannot be bought back,
• cannot be withdrawn to a bank account,
• cannot be converted into crypto assets.
The user accepts that credits are intended solely for in-platform use.
57. FAILED AI OPERATIONS
An AI operation may fail due to the following reasons:
• Model error
• Service interruption
• Network issue
• Provider-based error
• Moderation rejection
Caspy may, at its own discretion:
• issue a credit refund,
• grant a retry right,
• provide a partial credit refund.
However, there is no mandatory automatic refund for every failed operation.
58. PRICE CHANGES
Caspy may change the following elements:
• subscription fees,
• credit prices,
• premium advantages,
• credit consumption rates.
Users may be informed in advance where legally required.
59. REFUND POLICY
Purchases made via Apple and Google may be subject to the relevant store policies.
The user accepts the following:
• Refund requests may be handled through the relevant store.
• Caspy may provide voluntary support in some cases.
• A refund guarantee is not given for all purchases.
Local consumer legislation is reserved.
60. RESTORE PURCHASES
The user can restore their purchases in applicable situations.
Caspy may perform:
• purchase verification,
• account matching,
• fraud checks.
61. FRAUD AND ABUSE
The following are prohibited:
• Fake payment methods
• Chargeback abuses
• Use of stolen cards
• Obtaining credits unfairly
• Purchase manipulation
Caspy may apply the following operations:
• Credit deletion
• Premium cancellation
• Account suspension
• Account closure
• Initiation of legal processes
62. ACCOUNT DELETION AND CREDITS
When the user deletes their account:
• Premium membership advantages may end.
• Unused credits may be deleted.
• Credits may not be refunded.
Caspy does not assume an obligation to the contrary.
63. TAXES AND FEES
Where applicable:
• VAT
• sales taxes
• local duties
may be included in the prices or collected separately.
The user is responsible for their own tax obligations.
64. TERMINATION OF PREMIUM SERVICES
Caspy may do the following to any premium feature:
• remove,
• modify,
• replace with another plan.
This situation does not give rise to a claim for compensation against Caspy.
65. LIMITATION OF LIABILITY FOR PAID SERVICES
Caspy does not guarantee:
• specific results,
• specific visibility,
• specific follower increase,
• specific play counts,
• specific income levels.
Premium membership only provides access to additional features.

66. PLATFORM SAFETY AND COMMUNITY INTEGRITY
Caspy aims to create an environment where users can share content safely, creatively, and legally.
To this end, Caspy may:
• Apply content moderation,
• Conduct account reviews,
• Use security systems,
• Run automated detection mechanisms,
• Utilize human moderators,
• Use third-party security providers.
Caspy reserves the right to take any measures it deems necessary to maintain platform safety.
67. REPORTING SYSTEM
Users may report contents (Capsules, posts, Sparks), comments, messages, and accounts.
Caspy may use the following report categories:
Spam
Unsolicited or repetitive content.
Abuse
Harassment, bullying, or abuse.
Copyright
Copyright infringements.
Nudity
Inappropriate nudity or sexual content.
Impersonation
Identity impersonation.
Fraud
Fraudulent activities.
Deepfake
Deceptive synthetic media.
Other
Other violations.
Caspy may create new reporting categories.
68. EVALUATION OF REPORTS
Not every report means action will be taken automatically.
Caspy may:
• review reports,
• request additional information,
• conduct content review,
• decide to take no action.
Caspy's evaluation processes are entirely at its own discretion.
69. CONTENT MODERATION
Caspy may review contents using the following methods:
Automated Moderation
Machine learning systems.
Keyword Analysis
Detection of risky contents.
Visual Analysis
Visual and video review systems.
Audio Analysis
Review of uploaded audio.
Human Moderation
Evaluations conducted by authorized teams.
70. MODERATION OUTCOMES
Caspy may apply the following operations:
• Remove the content
• Request to edit the content
• Add an age tag
• Add a content warning
• Reduce visibility
• Remove from the algorithm
• Warn the account
• Suspend the account
• Close the account
Caspy's moderation decisions may be final.
71. VISIBILITY LIMITATION
Caspy may limit the visibility of certain contents or accounts.
This situation may be applied for the following reasons:
• Suspicion of spam
• Low-quality content
• Security review
• Deepfake risk
• Copyright risk
• Near-violations of community guidelines
Visibility limitation does not mean the account is closed.
72. ALGORITHMIC RECOMMENDATION SYSTEM
Caspy may use the following signals when generating content recommendations:
• Watch time
• Completion rate
• Rewatch rate
• Likes
• Follows
• Comments
• Rating scores
• Content types
• Music preferences
• Artist preferences
• Interaction history
Caspy does not guarantee that any content will be recommended.
73. BLOCK FEATURE
Users can block other users.
Blocked users may:
• Lose profile access,
• Not be able to access contents,
• Not be able to send DMs,
• Not be able to interact.
Caspy may change the scope of the blocking system.
74. MUTE FEATURE
Users can mute specific accounts.
Contents of muted users may:
• Be displayed less,
• Not generate notifications,
• Not appear in the user's feed.
75. DM (DIRECT MESSAGING) SERVICES
Caspy may offer direct messaging ("DM") services in the future.
The DM system may support the following:
• Text messages
• Visuals
• Videos
• Audio recordings
• Links
• Files
Caspy may activate or remove this feature at any time.
76. REVIEW OF DM CONTENTS
Caspy does not aim to routinely read users' private messages.
However, a review may be conducted in the following situations:
• Reporting
• Security investigation
• Suspicion of fraud
• Child safety violation
• Legal obligations
• Court orders
• Requests from authorized bodies
Users accept this situation.
77. DM REPORTING
Users can report private messages.
Reported messages may be reviewed by:
• Moderation teams,
• Security systems,
• Authorized personnel.
78. ACCOUNT REVIEWS
Caspy may conduct account reviews in the following situations:
• Copyright infringements
• Deepfake activities
• Spam behaviors
• Suspicious logins
• Fraudulent activities
• Security risks
The account may be restricted during the review period.
79. TEMPORARY SUSPENSION
Caspy may temporarily suspend accounts.
During the suspension period:
• Content sharing may be blocked,
• AI access may be stopped,
• DM access may be limited,
• Premium advantages may be suspended.
80. PERMANENT ACCOUNT CLOSURE
Caspy may permanently close the account in the following situations:
• Child safety violations
• Repeated copyright infringements
• Deepfake violations
• Identity impersonation
• Fraudulent activities
• Threats of violence
• Terrorist propaganda
• System manipulation
Caspy may apply these decisions without prior notice.
81. LAW ENFORCEMENT AND OFFICIAL AUTHORITIES
Caspy may cooperate with the following in line with valid legal requests:
• Law enforcement,
• Courts,
• Regulatory institutions,
• Authorized government agencies.
82. EMERGENCY SECURITY SITUATIONS
Caspy may immediately intervene in the following situations:
• Threats of self-harm
• Child safety risks
• Terrorist activities
• Death threats
• Risk of violence
• Fraud networks
In these situations, prior notification is not mandatory.
83. USER'S RIGHT TO APPEAL
Users can appeal certain moderation decisions.
Caspy may:
• Evaluate the appeal,
• Change the decision,
• Confirm the decision,
• Request additional documentation.
Caspy's final decision is binding.
84. RIGHT TO PROTECT PLATFORM INTEGRITY
Caspy may apply all technical and administrative measures it deems necessary to combat:
• algorithmic manipulation,
• fake engagement,
• bot networks,
• coordinated abuse,
• spam campaigns.

PART 6 – ACCOUNT DELETION, DATA RETENTION, LIMITATIONS OF LIABILITY, DISPUTES AND FINAL PROVISIONS
85. IN-APP ACCOUNT DELETION RIGHT
Users can delete their account at any time directly inside the mobile app by navigating to Settings -> Delete Account.
The same right may also be exercised from the web at https://app.caspy.co/delete-account, where identity is verified by an email code before deletion is executed. Both paths produce the same result.
Upon confirmation of account deletion, the user session is immediately terminated, and the following data are purged or anonymized:
• Profile information, username, biography, and profile visuals
• Capsule short videos and media assets
• Text posts and comments
• Follow, like, rating, and repost records
• Push notification tokens and block/mute preferences
Statutory tax, accounting, and security retention exceptions apply.
86. DATA THAT MAY BE RETAINED POST-ACCOUNT DELETION
Caspy may continue to retain the following data for legal and legitimate reasons:
Payment Records
Records relating to premium membership and credit purchases.
Accounting Records
Records kept for the purpose of fulfilling tax obligations.
Security Records
Fraud and abuse investigations.
Moderation Records
Reports, sanctions, and violation history.
Legal Records
Information necessary within the scope of disputes or official requests.
System Logs
Log files for technical and security purposes.
87. BACKUP SYSTEMS
Caspy may use regular backup systems.
The deletion of content by the user does not mean it will be instantly removed from the backup systems.
Backup records may be retained for limited periods for the purposes of:
• security,
• disaster recovery,
• system continuity.
88. DATA RETENTION PERIODS
Caspy aims to retain data only for as long as necessary.
Retention periods may be determined based on the following criteria:
• Legal obligations
• Contractual requirements
• Security needs
• Dispute risks
• Platform integrity requirements
Exact retention periods may be further explained in the Privacy Policy.
89. PROVISION OF SERVICES "AS IS"
Caspy services are provided "as is" and "as available".
Caspy does not guarantee the following:
• That services will operate uninterrupted,
• That they will operate error-free,
• That they will provide specific results,
• That they will perform at a specific level,
• That they will generate specific income,
• That specific follower or view counts will be reached.
The user uses the services at their own risk.
90. DISCLAIMER OF WARRANTIES
To the extent permitted by applicable legislation, Caspy does not provide express or implied warranties regarding the following:
• Merchantability
• Fitness for a particular purpose
• Non-infringement guarantee
• Uninterrupted access
• Prevention of data loss
• Accuracy of AI outputs
• Originality of AI outputs
• Copyright compliance of AI outputs
91. DISCLAIMER OF LIABILITY FOR AI OUTPUTS
Caspy does not guarantee that the contents generated by AI systems:
• Are accurate,
• Are up-to-date,
• Are legal,
• Are suitable for commercial use,
• Do not contain copyright infringement.
The use of AI outputs is entirely the user's responsibility.
92. THIRD-PARTY SERVICES
Caspy may utilize the following third-party services:
• Supabase
• Cloudflare Stream and Cloudflare Images
• RevenueCat
• Google OAuth
• Apple Sign In
• Firebase Cloud Messaging and Apple Push Notification service
• Google Gemini
• fal.ai
• Amazon Web Services
• Other service providers
Caspy cannot be held liable in the event of these services being interrupted or failing.
93. EXTERNAL LINKS
Caspy may allow users to share third-party links.
These links may be:
• Spotify
• Apple Music
• YouTube Music
• Social media platforms
• Personal websites
Caspy is not responsible for the contents of these services.
94. LIMITATION OF LIABILITY
To the extent permitted by applicable law, Caspy cannot be held liable for:
• indirect damages,
• loss of profit,
• loss of revenue,
• data loss,
• loss of business opportunity,
• loss of reputation.
95. MAXIMUM LIABILITY LIMIT
To the extent permitted by legislation, Caspy's total liability;
shall not exceed the total amount paid by the user to Caspy within the last twelve (12) months.
In some legal systems, this limitation may not apply.
In such a case, the relevant legislation will apply.
96. INDEMNIFICATION BY THE USER
The user agrees to indemnify Caspy against any damages it may incur due to the following:
• Contract breaches
• Copyright infringements
• Trademark infringements
• Personality rights infringements
• Disputes arising from AI contents
• Third-party claims
• Illegal activities
This provision may also cover Caspy's defense costs.
97. FORCE MAJEURE
Caspy is not responsible for delays or disruptions caused by the following reasons:
• Natural disasters
• War
• Terrorist incidents
• Cyber attacks
• Power outages
• Internet infrastructure issues
• Government interventions
• Third-party service interruptions
98. NON-WAIVER
Caspy's failure to exercise any right does not mean a permanent waiver of that right.
99. SEVERABILITY
If any provision of this Agreement is held to be invalid, the remaining provisions will continue to remain in effect.
100. ASSIGNMENT
Caspy may assign its rights and obligations under this Agreement to:
• its affiliates,
• its group companies,
• third parties in mergers or acquisitions.
The user cannot assign these rights without the written consent of Caspy.
101. GOVERNING LAW
This Agreement shall be governed by the Law of the Republic of Turkey, without regard to its conflict of laws rules.
102. AUTHORIZED COURTS AND EXECUTION OFFICES
In all disputes arising from this Agreement:
Izmir Courts and Execution Offices
have exclusive jurisdiction.
The user explicitly accepts this jurisdiction clause.

104. ENTIRE AGREEMENT
These Terms of Use;

• Community Guidelines,
• AI Labs Terms,
• Purchase and Subscription Terms,
• Copyright Policies,
• Other relevant policies
together constitute the entire agreement between Caspy and the user.
105. ENTRY INTO FORCE
This Agreement comes into effect the moment the user starts using Caspy services and remains valid as long as the user account is active.
106. CASPY AI LABS TERMS
The use of AI Labs services is additionally subject to the separate "Caspy AI Labs Terms" document.
These terms are an integral part of this Agreement and can be accessed in the app under Settings -> Legal -> AI Labs Terms, and on the web at caspy.co/ai-terms.
In the event of a conflict between this Agreement and the Caspy AI Labs Terms regarding AI Labs services, the Caspy AI Labs Terms shall prevail.
