AI Labs Terms
PART 1 – AI LABS GENERAL PROVISIONS, TERMS OF USE AND OWNERSHIP
1. INTRODUCTION
These AI Labs Terms ("AI Terms") regulate the use of generative artificial intelligence services offered by Caspy.
These terms:
• Are an integral part of the Caspy Terms of Service.
• Apply in conjunction with the Caspy Privacy Policy.
• Are binding for all users using AI Labs.
By using AI Labs services, the user is deemed to have accepted these terms.
2. DEFINITION OF AI LABS SERVICES
AI Labs may offer various artificial intelligence-supported tools, including but not limited to the following:
AI Lyrics
Song lyric generation.
AI Clip
Video generation. A completed clip may optionally be exported at a higher resolution (1080p, 2K or 4K) via HD Export.
AI Music
Audio track generation. Produces a track of 60, 120 or 180 seconds from a brief provided by the user, together with genre, mood and vocal-style (female, male, duet or instrumental) selections and optional song lyrics.
AI Visual
Visual generation.
AI Cover Art
Cover design generation.
AI Editing
Content editing tools.
AI Enhancement
Visual and audio enhancement tools.
Caspy may at any time:
• change,
• remove,
• limit,
• charge for
these services.
3. NATURE OF AI SERVICES
AI systems are based on probabilistic technology.
Therefore:
• The same prompt may yield different results.
• Results may be erroneous.
• Results may be incomplete.
• Results may not be original.
• Results may resemble third-party works.
Caspy does not guarantee that any AI output is:
• accurate,
• complete,
• original,
• unique,
• copyright safe.
4. AI LABS TERMS OF USE
While using AI Labs, the user is obliged to act in accordance with:
• applicable legislation,
• Caspy Terms of Service,
• Community Guidelines,
• Privacy Policy.
AI Labs cannot be used for illegal purposes.
5. DATA UPLOADED BY THE USER
Within the scope of AI Labs services, the user may upload the following contents:
• Audio files
• Visuals
• Reference visuals
• Cover visuals
• Texts
• Prompts
• Brief descriptions
• Their own photos
• Their own portraits
The user declares that they have the necessary rights over all contents they upload.
6. OWNERSHIP AND AUTHORIZATION DECLARATION
The user explicitly accepts the following:
The materials they upload:
• belong to them or,
• necessary licenses have been obtained or,
• are legally available for use.
The user cannot upload contents to AI systems for which they do not possess the necessary rights.
7. THIRD PARTY RIGHTS
The user cannot use the following in AI systems:
• Unauthorized photos
• Unauthorized audio recordings
• Unauthorized videos
• Unauthorized portraits
• Unauthorized brand materials
• Unauthorized artworks
The user is responsible for such violations.
8. USER'S USE OF THEIR OWN PHOTO
Caspy may allow users to use their own photos, portraits, and facial images in AI Labs generations.
In this case, the user declares and warrants that:
• the person in the photo is themselves,
• they are at least 18 years old,
• they do not upload photos belonging to third parties,
• they have given explicit consent for the visual processing activities.
9. SELF PORTRAIT SECTION AND FACIAL IMAGE PRIVACY
Under Self Portrait Beta, users may upload their own facial photos to maintain visual character consistency in AI clip projects.
The user agrees and warrants that:
• Self Portrait generation cannot proceed without an active consent declaration (Self Portrait Declaration, policy_version = 'v15.0') stored in the system.
• Uploaded photos and processed facial data are used strictly to generate the user's requested private AI assets.
• Facial and image data are never used for biometric identification, cross-app tracking, advertising profiling, or training public foundation AI models.
• Users may delete their uploaded reference images at any time within the app.
10. IMAGES OF MINORS
The following are strictly prohibited:
• Uploading children's photos
• Processing children's faces
• Using children's voices
• Creating a child identity
• Generating child likeness
• Generating child deepfakes
Caspy may immediately remove such contents.
11. FACE RECOGNITION AND IDENTITY LIKENESS
Caspy may use face processing technologies.
However, the user cannot:
• Impersonate third parties
• Create someone else's identity
• Create a deceptive identity
Caspy may reject productions it deems necessary.
12. CELEBRITIES AND PUBLIC FIGURES
The following are prohibited:
• Copying celebrity faces
• Cloning celebrity voices
• Impersonating public figures
• Fake interviews
• Fake statements
• Deceptive synthetic media
Caspy may remove such contents.
13. PROHIBITION OF IMPERSONATION
The user cannot:
• Impersonate identity
• Fake artist account
• Fake brand account
• Fake representative account
• Generate content on behalf of someone else
These violations are considered severe violations.
14. DEEPFAKE RESTRICTIONS
Caspy does not allow the use of deepfakes for the following purposes:
• Fraud
• Deception
• Manipulation
• Defamation
• Identity theft
• Harassment
Caspy may use deepfake detection systems.
15. VOICE CLONING POLICY
If voice cloning features are offered, the user declares that:
• They have necessary rights over the voice,
• They have obtained necessary permissions,
• They do not impersonate third parties.
Unauthorized voice cloning is prohibited.
16. OWNERSHIP OF AI OUTPUTS
To the extent permitted by applicable law, the user may hold rights over the AI outputs they generate.
However, Caspy does not guarantee the following:
• Copyright protection
• Exclusive right ownership
• Uniqueness
• Registrability
17. RIGHT TO COMMERCIAL USE
Unless stated otherwise by Caspy, the user may commercially use the AI outputs they generated.
This right may cover areas such as:
• music publishing,
• social media use,
• advertising works,
• art projects.
However, the user is responsible for the legal risks that may arise.
18. AI LABELING
Caspy may perform the following operations:
• Adding an AI label
• Displaying an AI-generated phrase
• Storing Provenance information
• Displaying model information
These operations may be applied regardless of user permission.
19. AI MODERATION
All AI productions may go through:
• automated review,
• security filters,
• manual review
processes.
Caspy may do the following to any production:
• reject,
• stop,
• remove,
• prevent its publication.
20. PRICING OF AI OPERATIONS AND CREDIT CONSUMPTION RATES
AI Labs services may consume virtual credits. Standard credit consumption rates are as follows:
• AI Lyrics Generation: 10 Credits
• AI Lyrics Refinement: 5 Credits
• AI Music Direction (style and lyric arrangement): 10 Credits
• AI Music 60-Second Track: 40 Credits
• AI Music 120-Second Track: 70 Credits
• AI Music 180-Second Track: 100 Credits
• AI Clip Storyboard Draft: 25 Credits
• Final Reference Image / Frame Revision: 25 Credits (frame revision: 12 Credits)
• AI Clip 15-Second 720p Video Render: 500 Credits
• AI Clip 30-Second 720p Video Render: 900 Credits
• AI Clip 45-Second 720p Video Render: 1300 Credits
• Segment Video Regeneration: 86 Credits
• HD Export 1080p: 100 Credits (15 sec), 175 Credits (30 sec), 250 Credits (45 sec)
• HD Export 2K: 250 Credits (15 sec), 450 Credits (30 sec), 650 Credits (45 sec)
• HD Export 4K: 500 Credits (15 sec), 900 Credits (30 sec), 1250 Credits (45 sec)
The rates above reflect the situation as of the date of these terms. The current cost of each operation is displayed to the user in the app before the operation is confirmed, and the amount displayed at that moment applies.
Caspy reserves the right to modify credit consumption rates based on model updates or provider cost changes.
CASPY AI LABS TERMS
PART 2 – AI PROVIDERS, DATA TRANSFER, COPYRIGHT RISKS, COMMERCIAL USE AND LIMITATIONS OF LIABILITY
21. AI SERVICE PROVIDERS
Caspy may utilize various third-party artificial intelligence providers to offer AI Labs services.
These providers may include:
• Google Gemini – lyric generation, storyboard planning, music direction, audio analysis
• fal.ai – the provider gateway through which the media models below are accessed
• MiniMax H3 (via fal.ai) – AI Clip video generation
• MiniMax Music 3 (via fal.ai) – AI Music track generation
• Nano Banana Pro (via fal.ai) – reference image generation and editing
• ByteDance Upscaler (via fal.ai) – HD Export (1080p / 2K / 4K) upscaling
• Amazon Web Services – rendering and video composition infrastructure
• Similar artificial intelligence providers
Caspy may change, remove, or add new providers over time.
By using AI Labs services, the user accepts the processing of data by these providers for the purpose of service provision.
22. DATA TRANSFER TO AI PROVIDERS
To operate AI services, the following data may be transferred to the relevant providers:
Text Data
• Prompts
• Brief descriptions
• Song lyric requests and lyric texts entered by the user
• Music briefs and genre / mood / vocal-style selections
• Commands
Visual Data
• Reference visuals
• Cover visuals
• Portraits
• Profile photos
Audio Data
• Audio recordings
• Reference audios
• Music files
Video Data
• Reference videos
• Capsule contents
This transfer is solely carried out to provide the AI service requested by the user.
23. MODEL TRAINING AND DATA USE
Caspy aims not to use user data to train its own AI models.
However, the data usage practices of third-party providers may vary.
Therefore, the user accepts that:
• The policies of relevant providers may apply,
• Caspy does not have full control over all activities of the providers.
Caspy tries to apply data minimization to the extent possible.
24. PROMPT OWNERSHIP
Prompts and brief descriptions created by the user remain the property of the user.
However, the user grants Caspy and relevant AI providers the following rights:
• Processing
• Analyzing
• Generating production
• Applying moderation
• Conducting security checks
This license is used solely for the purpose of providing the services.
25. COPYRIGHT RISKS IN AI OUTPUTS
The user accepts the following:
AI outputs;
• May resemble third-party contents,
• May produce similar works,
• May be subject to copyright disputes,
• May create commercial risks.
Caspy does not guarantee that any AI output:
• Does not contain copyright infringement,
• Is registrable,
• Is suitable for commercial use.
26. MUSIC AND LYRIC PRODUCTIONS
Song lyrics generated by AI Lyrics and audio tracks generated by AI Music:
• May resemble human works,
• May show similarity to publicly available contents,
• May produce similar results with other users,
• May not be eligible for copyright protection under the legislation of certain countries.
The user is obliged to conduct the necessary legal review before publishing.
For AI Music in particular, Caspy makes no representation as to whether the output may be registered with a collecting society, distributed to digital music platforms, or monetized; verifying this is entirely the user's responsibility.
Where the user supplies lyrics manually for AI Music, they declare and warrant that those lyrics belong to them or that they have obtained the necessary permissions. Entering the lyrics of a third party's copyrighted work is prohibited.
27. REFERENCE MATERIALS
The user declares that they have the necessary rights over the contents they upload as a reference.
These contents may be:
• Visuals
• Cover designs
• Audio recordings
• Video recordings
• Photos.
Uploading materials without ownership rights is prohibited.
28. COMMERCIAL USE RESPONSIBILITY
Caspy may allow the commercial use of AI outputs.
However, the user is responsible for:
• Copyrights
• Trademark rights
• Personality rights
• Advertising legislation
• Consumer legislation
• Local legal obligations
Caspy is not responsible for disputes arising from commercial use.
29. LABELING OF AI CONTENTS
Caspy may implement the following practices:
• "AI Generated" label
• "AI Assisted" label
• Content warnings
• Provenance records
• Model information display
These practices may be used for platform security purposes.
30. PUBLICATION OF AI CONTENTS
The publication of contents generated by AI may be subject to Caspy's approval.
Caspy may:
• Refuse to publish,
• Request additional review,
• Restrict the content,
• Remove the content.
31. SECURITY AND MODERATION
AI contents may be blocked for the following reasons:
• Deepfake risk
• Identity impersonation
• Child safety risk
• Hate speech
• Call for violence
• Terrorist propaganda
• Suspicion of copyright infringement
• Spam generation
Caspy's security decisions may be final.
32. CREDIT REFUNDS
Caspy may provide a credit refund in the following situations:
• System error
• Technical malfunction
• Transaction never completing
However, a refund is not mandatory in the following situations:
• Not liking the result
• Expectations not being met
• Creative preferences
• Requests rejected due to moderation
33. SUSPENSION OF AI SERVICES
Caspy may limit AI access in the following situations:
• Suspicious activity
• Credit abuse
• Deepfake violations
• Security risks
• Account reviews
34. APPLE APP STORE COMPLIANCE
Caspy AI services strive to be operated in compliance with Apple App Store rules.
Caspy does not allow the following contents:
• Child abuse contents
• Deceptive synthetic media
• Harmful deepfake contents
• Identity impersonation contents
As Apple's requirements change, Caspy may update its policies.
35. GOOGLE PLAY COMPLIANCE
Caspy AI services strive to be managed in compliance with Google Play policies.
Caspy may restrict the following contents:
• Harmful contents
• Spam generations
• Generations for fraudulent purposes
• Contents causing copyright infringement
36. DISCLAIMER OF WARRANTY
Caspy does not guarantee the following:
• Accuracy of AI outputs
• Uniqueness of AI outputs
• Copyright safety of AI outputs
• Commercial success
• Specific quality levels
AI systems may bear the nature of experimental technology.
37. LIMITATION OF LIABILITY
To the extent permitted by applicable legislation, Caspy cannot be held liable for:
• Indirect damages,
• Data losses,
• Revenue losses,
• Commercial losses,
• Opportunity losses.
38. INDEMNIFICATION BY THE USER
The user agrees to indemnify any damages Caspy may incur due to the following reasons:
• Copyright infringements
• Trademark infringements
• Unauthorized portrait use
• Deepfake violations
• Third-party claims
• Illegal AI use
39. TERMINATION OF AI LABS SERVICES
Caspy may do the following to any AI feature:
• remove,
• stop,
• change,
• charge for it.
The user cannot expect a specific AI feature to be continuously offered.
